What is Family Mediation?

Family mediation is the process by which parties discuss their dispute with an impartial third party (the mediator). The mediator can assist couples in reaching their own agreement on issues such as financial settlement, property division, child custody and/or parenting plans. It can also be used to address non-legal issues such as communication.

This type of mediation is a form of Alternative Dispute Resolution (ADR) and helps the parties avoid the expense and emotional trauma of court proceedings. It encourages a healthy, positive relationship for the benefit of the children and can result in an amicable separation.

It is not unusual for families who enter the session embroiled in extreme tension to leave reminiscing about happy times and new beginnings. It may seem superficial, but logistical agreements such as safe boundaries and rules for respectful future interactions can create an entirely new dynamic.

If you agree to mediation, the mediator will help you explore all of your options, consider whether they would work in practice and then facilitate discussions with the other party to try and reach an overall solution. If you do reach an agreement, your mediator will draft a formal memorandum of understanding so that everyone understands what has been agreed to.
